Complex Issues in Guardianship

About This Course

In this course, we'll address complex issues that certified professional guardians and conservators (CPGCs) encounter, specifically ethics, communication and advocacy. We'll discuss the complicated conflicts of interest created by the overlap of guardianship or conservatorship as a legal obligation, a business and a social good. We'll also cover issues related to the professionalism of CPGCs (governance, relationship to the court and disciplinary process) and operating a business.

The case-study scenarios become more complicated in this course. You’ll tackle more complex financial, legal and medical decision-making issues, and you’ll receive instruction on extra statutory tasks, restoring incapacitated people’s rights and terminating guardianships.

  • How to negotiate complex decisions related to medical care and financial management

  • Practical strategies for developing effective relationships with the courts and other involved parties, including engaging in constructive problem-solving and developing high-quality reports

  • Strategies for amending or terminating protective arrangements

  • The obligations of professionals to their clients, the courts, the Certified Professional Guardianship and Conservatorship Board, the profession and broader society

  • The role of CPGCs in addressing the social oppression of people with cognitive disabilities in the U.S., strategies for identifying personal biases and meaningful steps to address discrimination toward clients
